The Service relies in part on information and services provided by third parties.

Searcher does not guarantee:

  • The accuracy, completeness, or timeliness of third-party data
  • Continuous availability of external data feeds
  • Uninterrupted access to vessel tracking or survey information

Third-party content, trademarks, logos, and intellectual property remain the property of their respective owners.

4. Service Limitations and Availability

Searcher will make reasonable efforts to keep the Service operational and accessible. However, to the fullest extent permitted by law, Searcher does not guarantee that the Service will always be:

  • Available
  • Uninterrupted
  • Error-free
  • Accurate
  • Up to date

The Service may experience outages, delays, maintenance periods, technical interruptions, or data latency.

Searcher reserves the right to modify, suspend, discontinue, or restrict access to any part of the Service at any time without notice or liability.

5. No Reliance

The Service is provided for general informational and professional intelligence purposes only.

While Searcher aims to provide accurate and timely information, users acknowledge that information within the Service may be incomplete, delayed, inaccurate, or unavailable.

The Service must not be relied upon as the sole basis for:

  • Commercial decisions
  • Investment decisions
  • Operational decisions
  • Navigation or marine safety decisions
  • Legal or regulatory compliance decisions

Users are responsible for independently verifying information where necessary.

Certain features of the Service may require account registration or authorised access.

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity conducted under your account
  • Ensuring your account information remains accurate and current

You must not:

  • Share account credentials with unauthorised users
  • Attempt to gain unauthorised access to the Service
  • Circumvent security measures or access restrictions

Searcher reserves the right to suspend or terminate access where misuse, unauthorised activity, or breach of these Terms is suspected.

You agree not to:

  • Use the Service for unlawful purposes
  • Copy, scrape, harvest, or extract data using automated means
  • Redistribute or commercially exploit Service content without written permission
  • Reverse engineer or interfere with the App or its infrastructure
  • Introduce malicious software or attempt to disrupt the Service

8. Intellectual Property

All intellectual property rights in the App and Service, including software, branding, graphics, interfaces, datasets, and content, are owned by or licensed to Searcher.

No rights are granted except as expressly stated in this Agreement.

You may not reproduce, distribute, modify, sell, or commercially exploit any part of the Service without prior written consent from Searcher.

This Agreement continues until terminated by you or Searcher.

You may terminate the Agreement at any time by:

  • Uninstalling the App
  • Cancelling any applicable subscription
  • Ceasing use of the Service

Searcher may suspend or terminate your access immediately if:

  • You breach these Terms
  • Your use creates risk or liability
  • The Service is discontinued

Users accessing the Service from outside Australia are responsible for complying with local laws and regulations applicable in their jurisdiction.

Searcher makes no representation that the Service is appropriate or available in all regions.

13. Changes to the Terms

Searcher may update these Terms from time to time.

Where material changes are made, Searcher may provide notice through the App, website, or by email.

Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law and Jurisdiction

This Agreement is governed by the laws of Western Australia.

You submit to the exclusive jurisdiction of the courts of Western Australia and applicable Australian courts in connection with any dispute arising from these Terms or the Service.

Personal data provided will be processed by Searcher Seismic Pty Ltd in accordance with its Privacy Policy, available on request, and used for the purposes of providing updates on any future changes to the app. People who opt in at the point of account creation consent to their personal data being used by Searcher Seismic Pty Ltd for future marketing communications, including updates on products, services, and events. Entrants may withdraw this consent at any time by contacting Searcher at sales@searcherseismic.com. Searcher will handle all personal data in accordance with applicable data protection legislation.
